Swiss Residence and Real Estate

Residence status and nationality may directly affect what a foreign client can buy in Switzerland. Understanding the connection between residence and property rights is essential before proceeding with any acquisition.

Advisory disclaimer: General information only. Property acquisition rights depend on nationality, permit type, canton, property type and individual circumstances. Lex Koller analysis must be performed before any transaction. Consult a qualified Swiss notary or lawyer.

The Role of Lex Koller

Lex Koller (Bundesgesetz über den Erwerb von Grundstücken durch Personen im Ausland, BewG) is the Swiss federal law that regulates the acquisition of real estate by persons abroad. It applies to non-resident foreign nationals, certain permit holders and foreign-controlled structures.

Lex Koller analysis must be performed before any property transaction involving a foreign buyer. The analysis depends on the buyer's nationality, residence status, permit type, the property type and the canton.
